I'm at stage 3, my first appontment was for increases on my currently rated knees and back, and then for a new claim on tinnitus.

Looks like VA has all your doc from C&P. It’s a waiting game now. Can be 1 month, 6 months or more.
Check progress bubble every other week if you can wait that long. Once it shows complete on last bubble your letter will be there to look/download/print. Letter will be sent to you about 2 weeks after last bubble lit up.

Any denial- contact VetComm see if they can rev up pressure with letter or oth evidence required from u. 2nd round with VetComm is $500. If you can get 90-100% it’s well worth it.

There’s a VA 800 number , think it’s at the bottom of the claim page. You can call and ask any questions. They can be helpful.

Congratulations ! 90% you are almost there Yipee ! The deferred item is still in the system. It would be the disability that is more complicated or complex. Deferred means it’s still being looked at and unless it’s deniable due to no DX you should still be looking for a C&P in the future.

If you haven’t put in another intent to file do it now/today.

Wait until the deferred item is adjudicated. If you are still not 100% when the deferred item is done. Go back to VetComm (it’ll be another $500) and get another claim work up going.

The denial letter says why you are denied. Read that and correct the issue(s) if you can.

If VetComm has u submit supplementals for the denials that’ll use your intent to file. Turn in another immediately after u file.

You need another combination of disability of approx 50%.- 20%x2 and a 10% 40% and 10%.

Did you file for anxiety or migraines /headache those are normally good for 50%. Both/either are secondary for most any other disability. Second to tinnitus is common - you will need Dr records showing you are complaining about both or either if that’s a issue for you.

I was at 90% with 1 item deferred it took another 2 months and 2 C&P exams with different companies for the same issue. Got my 100%. Don’t be discouraged with that deferred item.

I did file for migraines and PTSD and those were the denied without any exam or questions.
This is all the letter said
Service connection for posttraumatic stress disorder is denied.
Service connection for migraines (headaches) is denied.

Really? The letter should list: you are awarded xx% on disability abc and to get a higher rating 123 must apply. You are denied abc because 123 and 456. You are denied abc not service connected. Disability abc has been deferred.

Do you have medical evidence by a doctor showing you have been diagnosed with these problems and are you currently being treated for these ? If you do. Did you submit these with your claim ?

Only reason I know deny with no cp no DX and current treatment. Or not service connected

1) Get that intent to file in if u haven’t.
2) Text VetComm with your results- wait for deferred item to adjudicate before proceeding with further claims.

Again- 90% WOW Congratulations that’s a nice paycheck you didn’t have before. Celebrate that win !

Do you have a VSO ? If not go get one. Ask if they can look at why u were denied w/o c&p. They can see look at file & see what happened.

You already used up the intent to file when you filed your claims for disability . Always open a new intent to file right after filing a claim, submitting a supplemental to a claim that was denied or an appeal. Get a new internet started ASAP.

You can file an intent at any time. It is telling the VA you plan to file a claim within the next year. Soon as you file a claim, a supplemental, appeal that intent is used. It is the back pay date marker. It is only good for 1 set of claims. Must make new intent to file after each submission is made. Does that make sense?

No don’t file appeal that’s a last resort takes too long and the finding will be you have no service connection. You will only end up waiting 6 plus months and get denied again AND you will never be able to file for that ever again.

Ok that makes total sense. VA found- no service connection on both claims. Reason you got no C&P. This is what you need to do. You have up to 1 yr to fix this.

Highly recommend contact VetComm to help resubmit these denials - wait for the deferred claim to finish do not submit anything except an intent to file before proceeding or going back to them. Try to use the same person unless you didn’t click ask for a new claim rep. You should have a text or email for your rep correct ? They will charge $500 for the next batch of claims. They do want you to get 100%.

The VA told you exactly how to correct this:

1- headaches- seems you have a diagnosis in your record is that correct ? However it’s not connected to a service-connected condition. Was this submitted as a new condition ? Was it submitted as 2nd to a rated condition ? This can rebutted by submitting as a supplemental (not an appeal) with new evidence as a secondary to a condition that is already rated. Complain to your doctor that your headaches are being caused by disability XY or Z get it in your medical record then make a copy of it to send in with supplemental. Make a headache/ migraine log (2-3months) submit that too.

2- PTSD - No evidence showing you have a diagnosis nor is it caused by any of your rated conditions.. You need your doctor to diagnose and treat you for a mental health condition (any mental health condition). Anxiety is more common than PTSD. You might have anxiety due to one other service connected disability. This can be submitted and a 2nd to a rated condition after your doctor diagnoses and treats you.

Cannot start a new- Intent to file ? Really, I’ve done that multiple times. I have always submitted my claims then went back in and put in a new intent immediately after. I have one still active from the date I submitted my last claim.

The date shown (expiration date) will be your back pay date holder. You have 1 yr to finish this claim. Click the link at green arrow. Select the top button. Continue on to step 2 if u already have ITF it’ll tell you and give date of it. Select “finish layer” or you can continue and fill out some of the form then “finish later “ You can change any of the information when you complete it for submission. You have 1yr to use it. VetComm will see you started it when they help you.
