Newsom said in a statement. "Californians voted to require background checks on ammunition and their voices should matter."
Ummm... no. Our Constitutional Rights are subject neither to the democratic process (a majority vote) nor to arguments grounded in social utility.
Federal appeals court rules California ammunition background checks unconstitutional
A federal appeals court ruled that California's law requiring gun owners to undergo background checks to purchase ammunition violates the Second Amendment right to bear arms.
The injunction was issued by U.S. District Judge Roger Benitez in San Diego. An appeals court panel placed the injunction on hold while California's appeal played out.
Of course, the ruling has no teeth, AS USUAL. It will take YEARS... if ever.... to actually restore Constitutional Rights which have been illegally subverted. My bet is that the Circuit Court will overturn it, and the SCOTUS will refuse to hear it.... and we're back where we started.
