Yuge! Vets- get rated for all your disabilities

I had my C&P exam for hypertension today - They do 3 readings in a row.
All of them were over 150 / over 90 and I am on 2 medications for hypertesnion.
She dd have my statement to the VA with me reasons to link it to my back and knees including medical research linking it.

I especially like this one :)

VA/Medical Community Recognition
Key Point: The VA's own guidelines (M21-1, Adjudication Procedures Manual) allow for
secondary service connection if a condition is caused or aggravated by a service
connected disability - this includes hypertension caused or worsened by pain, stress,
medications, or reduced mobility from orthopedic injuries.

VA denied my hypertension as I had not been diagnosed when I was in the Navy - totally ignoring the medical research.
Was that the deferred item ?
I suspect this was submitted as a new disability that lacks an in service nexus.
Should be submitted as a secondary to a rated disability.
Same with PTSD- or Anxiety/depression. Anxiety maybe easier to prove.

Suggest get DX from Dr. documented in med records of all denied disabilities if not already done. Get treatment or continue treatment of those disabilities. Get your evidence together to re-submit as a supplemental (with new evidence) to show service connection OR resubmit as a secondary to a disability that already rated.
Contact VetComm if that was last one of the 1st round you did with them.

Remember the key is you need 3 components to get rated for a “new” claim.

1. A disability that is currently ongoing today (chronic). Diagnosed, being treated and documented.
2. In service event, injury, illness. - Need evidence showing it’s a result of service. Buddy letter, service record, treatment IN SERVICE.
3. Medical nexus (normally the hard part). The medical opinion from a professional that connects the current disability to the in-service event.

Secondary’s are easier because the in service event is already covered . Just need to show current DX, treatment and have a Dr opinion that disability is caused by disability ABC that’s already rated. Get your Dr. to annotate it on your record. IE- hypertension is due to back injury. Is taking meds etc…. Anxiety is result of patient injuries, is taking pills and getting counseling

It was hypertension, filed secondary to my knees and back

So, if I go to my normal doc and get a nexus letter can I simply follow the supplimental claim process?
"If you have new evidence that shows your condition is service connected, you can file a Supplemental Claim"

Ops sorry I missed this. Message me if I don’t reply within a couple days.

Supplemental is the best avenue to object to a denial. Adjudication is fairly quick. You can provide new evidence each time you submit another supplemental for same claim. You have a yr to collect new evidence to try again, it’s not final. (Appeal is a one time shot, no new evidence accepted and it’s final, cannot file again)

DBQ is 100% better than any letter.
Here’s what u need to do-
Print out the 👉🏼DBQ 👈🏼for hypertension fill out what you can ask Dr to provide medical evidence & option for all medical information. Dr needs to sign and provide, In the option she needs to write the following : hypertension is more likely than not proximately caused by their service-connected XYZ (chronic back pain and or knee) Or similar wording see the photo I left below. Use the statement that best fits your situation. This statement and opinion is mandatory in order to get rated.

Required wording for VA to rate you using DBQ or Nexus letter👇👇👇👇

Appeals evidence you may be able to use- read em and submit any of this information in your claim to show they rated same condition.
Here’s claims that has been approved for 2nd to back. Look at conclusions see if you have or can provide similar evidence with your supplemental.

38 CFR rating requirements - blood pressure 👈🏼 very important to provide numbers in DBQ
Section 7101

Look at this- hypertension 2nd to pain I believe will require more work than normal.

If you submit this and it gets denied again- suggest you go back to VetComm for another shot at everything that got denied & submit new secondary’s on claims that got approved on the 1st round. Go after 100%. It’ll be worth the extra $500. I believe you have a great chance of getting rated for (mental heath) anxiety and or depression as a secondary. If you haven’t started getting treatment for those get er going. That’s a for sure pathway to 100%

I saw Kate on Newsmax today - Sadly I did not get to hear what she was saying about Newscum.

The gal who helped me file my claims agreed that the hypertenshion should not have been denied for not being a condition I had in the military and asked me to forward my decision letter to her, so I did.

We will see what happens.

Thanks, Chief!
