VA denied my hypertension as I had not been diagnosed when I was in the Navy - totally ignoring the medical research.
Was that the deferred item ?
I suspect this was submitted as a new disability that lacks an in service nexus.
Should be submitted as a secondary to a rated disability.
Same with PTSD- or Anxiety/depression. Anxiety maybe easier to prove.
Suggest get DX from Dr. documented in med records of all denied disabilities if not already done. Get treatment or continue treatment of those disabilities. Get your evidence together to re-submit as a supplemental (with new evidence) to show service connection OR resubmit as a secondary to a disability that already rated.
Contact VetComm if that was last one of the 1st round you did with them.
Remember the key is you need 3 components to get rated for a “new” claim.
1. A disability that is currently ongoing today (chronic). Diagnosed, being treated and documented.
2. In service event, injury, illness. - Need evidence showing it’s a result of service. Buddy letter, service record, treatment IN SERVICE.
3. Medical nexus (normally the hard part). The medical opinion from a professional that connects the current disability to the in-service event.
Secondary’s are easier because the in service event is already covered . Just need to show current DX, treatment and have a Dr opinion that disability is caused by disability ABC that’s already rated. Get your Dr. to annotate it on your record. IE- hypertension is due to back injury. Is taking meds etc…. Anxiety is result of patient injuries, is taking pills and getting counseling
